You Could Be Arrested For Texting While Driving... Soon.

14 of the 50 United States have passed laws prohibiting the use of text messaging while driving. While various studies have been done to compare the use of driving and using a cell phone in a orthodox manner (i.e. talking) little has been studied on text messaging and driving. Although, one study by Virginia Tech Transportation Institute, Virginia being one of the fourteen, has gone so far to say truck drivers are 5.9 times more likely, versus 2.8 for car drivers, to get in an accident. Conversely, truck drivers listen better, apparently 76% better, at 1 times likely instead of 1.3 times as likely with car drivers.

As to another point almost no studies have been done to test the use of hands-free wireless devices. The Virginia Institute went so far to say using a hands-free device caused a plausible percentage in lessening the risk in getting into a car accident. However, no other studies, even in the long list of credentialed studies we list in Don't Talk and Drive mentioned no results. With the public understanding the risks of commercial crashes, example: the high profile Boston, MA. trolley crash killing 62 people from an operator texting, elected officials are not wasting any time protecting the public.

The issue, however, is whether the federal government has the right to intervene on the peoples behalf from a consumer or civilian argument. While studies concretely show evidence of public risk on the commercial industry, especially public transportation, does the federal government have the right to tell you, "you can't talk right now." Additionally, it is easy to compare intoxication while driving to using a cell phone and driving; however, some States - in fact, many States - allow the use of hands-free devices. We urge you to inform your elected representative to look at this as an option as other States have - even if to urge more conducive studies.
